A Reset for European Defense Procurement Policy: Navigating Between the Internal Market and Industrial Policy
Dominik will give an overview of the regulatory framework of defence procurement in the European Union, including on legal constraints for offset arrangements under EU law. In light of the recent announcements of European States and the EU Commission alike to implement new tools to “ReArm” Europe, we will discuss new concepts like a “national preference” in defence procurement, regulatory changes to facilitate defence industry consolidation and new financing tools for cooperative procurements. These developments will have an impact on future industrial cooperation models in the EU and are therefore highly relevant for GICA conference participants.
Dominik Eisenhut is Senior Legal Counsel at Airbus in Toulouse where he – inter alia – advises on EU law matters, including on topics related to industrial participation, offset, and geo return agreements. Prior to taking up his position at Airbus, he worked as a corporate attorney in Munich and at the Chair of International and European Law at the University of the German Armed Forces. Dominik holds a Ph.D. from Augsburg University on the applicability of EU law in the area of defence and security, and an LL.M. from University College London. He is a contributor to different TEU/TFEU commentaries and author of several articles on Article 346 TFEU and on other aspects of EU law in the field of security and defence.
